Terms & Conditions

Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the clinical and telemedicine services (the “Services”) provided by Endura Medical Limited (“Endura Medical,” “we,” “us,” or “our”), including our High Altitude Clinics on Kilimanjaro and our Telemedicine consultations. By booking an appointment, attending a consultation, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

 

Description of Services

Endura Medical provides the following clinical services:

a) High Altitude Clinics. In-person medical appointments provided at clinic locations on or around Mount Kilimanjaro, primarily for the assessment and treatment of altitude-related illness and other medical needs arising during high altitude trekking or climbing.

b) Telemedicine. Remote consultations with licensed healthcare providers conducted by video, phone, or other telecommunication technology, for the assessment, advice and ongoing management of medical conditions that do not require an in-person physical examination.

Both Services are provided by licensed healthcare professionals. The scope of any individual consultation is determined by the treating provider based on clinical judgment, and may include a referral to in-person, hospital-based, or emergency care where appropriate.

Eligibility and Patient Registration

You must be at least 18 years old, or accompanied by a parent or legal guardian, to receive our Services. Before your first appointment, you will be asked to provide accurate identifying, contact and health information. You are responsible for keeping this information current and accurate, and for informing us promptly of any change relevant to your care.

 

Scope and Limitations of Telemedicine

a) Not a Substitute for In-Person Care. Telemedicine consultations are limited by the information you provide and the absence of a hands-on physical examination. Certain conditions cannot be safely or adequately assessed remotely. Your provider may recommend an in-person evaluation, hospital visit, or emergency care where remote assessment is not sufficient.

b) Technology Requirements. You are responsible for ensuring you have a stable internet or phone connection adequate for your consultation. Connectivity issues, particularly in remote or high altitude areas, may interrupt or delay a consultation.

c) Location and Jurisdiction. Our Telemedicine providers are licensed to practice in specific jurisdictions. It is your responsibility to inform us of your location at the time of consultation, as this may affect what care can be lawfully provided to you remotely.

 

High Altitude Environment - Assumption of Risk

a) Inherent Risks. You acknowledge that trekking, climbing and spending time at high altitude on Kilimanjaro carries inherent risks, including but not limited to Acute Mountain Sickness, High Altitude Pulmonary Edema, High Altitude Cerebral Edema, exposure, and injury related to terrain or weather. Our High Altitude Clinics are designed to assess and treat these conditions where possible, but cannot eliminate the underlying risks of the environment.

b) Clinic Resource Limitations. Our High Altitude Clinics are not equipped to the same standard as a hospital. Where a condition requires resources beyond what the clinic can provide, our providers will recommend descent, evacuation, or transfer to a higher level of care, and you agree to follow such recommendations promptly.

c) Evacuation and Insurance. Emergency evacuation from high altitude can be delayed by weather, terrain and logistics, and is not guaranteed to be immediate. We strongly recommend that all patients using our High Altitude Clinics hold travel insurance that includes medical evacuation coverage before undertaking any high altitude activity.

Patient Responsibilities

You agree to:

  • Provide accurate and complete information about your health, symptoms and medical history

  • Follow the advice, instructions and treatment recommendations given by our healthcare providers

  • Inform us of any known allergies, medications, or pre-existing conditions relevant to your care

  • Disclose promptly if your symptoms worsen or change during or after a consultation

  • Treat our staff and providers with respect and courtesy

 

Healthcare Provider Qualifications

All clinical care under these Services is delivered by licensed healthcare professionals. Our providers are licensed and registered with the applicable medical regulatory authorities, including the Medical Council of Tanganyika where applicable, and any other relevant regulatory body where a provider is licensed to practice telemedicine from a different jurisdiction.

 

Appointments, Scheduling and Cancellations

Appointments for High Altitude Clinics and Telemedicine consultations are arranged in advance. If you need to cancel or reschedule, please notify us as early as possible, ideally at least [Insert number, e.g. 24] hours before your scheduled appointment. Repeated late cancellations or missed appointments without notice may result in a cancellation fee or restrictions on future bookings, the details of which will be communicated to you at the time of booking.

 

Fees and Payment for Services

Fees for High Altitude Clinic appointments and Telemedicine consultations are communicated to you at the time of booking or invoicing. Payment is due before or at the time of your appointment, unless other arrangements have been agreed in writing. We do not bill insurance directly; if you intend to claim against travel, medical or health insurance, you are responsible for submitting your own claim using the documentation we provide.

 

Medical Records and Confidentiality

We maintain records of your consultations and treatment in accordance with our Privacy Policy. Your health information is treated as confidential and is shared only with those directly involved in your care, or as required by law. Please refer to our Privacy Policy for full details on how your information is collected, used and protected.

 

Acceptable Use of Our Website and Booking Platform

When using our website or any booking platform to access our Services, you agree not to misuse the platform, attempt to gain unauthorised access to other patients' information, interfere with the platform's normal operation, or use it for any purpose other than arranging and managing your own care.

 

Intellectual Property

All content related to our Services, including educational materials, the Endura Medical name and branding, is owned by or licensed to Endura Medical Limited. You may not copy, reproduce or distribute this content without our prior written permission.

 

Disclaimers

Our Services are provided based on the clinical judgment of the treating provider using the information available at the time. We do not guarantee a particular diagnosis, treatment outcome, or full resolution of any condition. Medicine, particularly in remote and high altitude settings, involves inherent uncertainty.

In plain language: Our providers do their best with the information in front of them, but no clinic, on a mountain or on a screen, can promise a specific outcome.

 

Limitation of Liability

To the maximum extent permitted by law, Endura Medical Limited's liability for any claim arising from the Services is limited to the fees paid for the specific consultation or appointment giving rise to the claim, except where such limitation is not permitted by law, including in cases of gross negligence or wilful misconduct.

 

Indemnification

You agree to indemnify and hold Endura Medical Limited, its providers, directors and staff harmless from any claim, loss or damage, including reasonable legal fees, arising from your failure to disclose accurate health information, your failure to follow medical advice given to you, or your misuse of our Services.

Termination of the Provider-Patient Relationship

We may end the provider-patient relationship for reasons including non-payment, repeated non-compliance with treatment recommendations, or abusive or threatening behaviour toward staff. Except where there is an immediate risk to safety, we will provide reasonable notice and, where practicable, a referral to alternative care.

In plain language: We can end a care relationship in serious situations, like abuse toward staff or repeatedly ignoring medical advice, but we will normally give notice and try to point you toward other care first.

 

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict of law principles. Any dispute arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of the United Republic of Tanzania. Before initiating formal proceedings, both parties agree to attempt to resolve any dispute informally by contacting the other party first.
